Terms of use

Updated October 26, 2026.

1. The service

Fondacle helps coaches keep track of their clients from their sessions: profile, steps, tasks, decisions, recaps and reviews. By creating an account, you accept these terms and the privacy policy.

2. Your account

  • Keep your credentials secret. We recommend turning on two-factor authentication.
  • You're responsible for what's done from your account.

3. Your clients' consent (required)

Before recording, transcribing or importing a session into Fondacle, you inform your client and get their consent for:

  • recording and transcribing the session;
  • analysis of the transcript by an artificial intelligence tool hosted in the European Union;
  • keeping this information for their follow-up, for the length of the coaching.

Keep a record of this consent (coaching contract, email, form). Example sentence to add to your contract:

"I agree that our sessions may be recorded, transcribed and analyzed by an artificial intelligence tool (Fondacle, hosted in the European Union), solely to support my follow-up. I can withdraw my consent at any time."

If your client refuses or withdraws consent, stop recording their sessions, and delete those already there if they ask (Client profile › Settings).

For your clients' data, you are the data controller under the GDPR; Fondacle acts as processor and only uses it to provide the service to you.

4. What the AI does

  • The AI reads your sessions and updates the follow-up: each item is based on an exact sentence from the transcript.
  • Automatic updates and automatic recap sending are set in Settings › Automatic. You can edit, remove or turn off anything.
  • The AI can make mistakes. You remain responsible for what you keep in the follow-up and what you send your clients.
  • Fondacle is not a medical tool and doesn't make any decision for you.

5. What you put in Fondacle

  • Only what's useful for the follow-up. Avoid health data and other sensitive data, unless it's necessary and accepted by your client.
  • No illegal content, and no data about people who aren't your clients without their consent.

6. Your data

  • Hosted in the European Union, access limited to your account.
  • Full export of your data (CSV, JSON, formatted PDF) and permanent deletion of a client at any time.
  • Your data isn't used to train AI models.

7. Plans

Each plan has its limits (active clients, sessions analyzed and AI questions per month, file storage) and its features. They're shown in Settings › Subscription and on the Pricing page.

A plan (Free, Plus, Pro, Max or Studio) is made for one person, or for a team working in a single workspace: you can invite as many colleagues as you want. Beyond that, the Enterprise plan is by quote. Opening several accounts for the same organization to get around a plan's limits isn't allowed; we can offer to merge those accounts into a single workspace, without losing anything.

8. Prices and payment

  • Prices are in dollars, per month, excluding VAT. Your country's VAT is added to the payment; it's shown before paying and on the receipt. A business in the European Union can enter its VAT number.
  • Payment is by card, in Fondacle, through our payment provider. Fondacle never sees or keeps your card numbers. Only the workspace holder pays.
  • The subscription renews every month, on the same date, until you stop it.
  • Upgrading : the new plan is paid right away; the days already paid on the old one are credited to the new one, at the same price per day.
  • Downgrading : nothing is charged right away; the new plan starts at the end of the month already paid.
  • Top-ups (calls, questions, leads): paid once, they stay available until used.
  • Referral : months earned are credited to your paid subscription.

9. Cancellation and refunds

  • You can stop your subscription whenever you want (Settings › Subscription, by switching back to Free). It stays active until the end of the paid month, then the workspace goes to Free; nothing is erased. Deleting your account also stops the subscription.
  • A month started is due and isn't refunded, nor is a purchased top-up. If we make a mistake (double charge, service down for a long time), write to us at contact@fondacle.com: we'll refund you.
  • Fondacle is a professional tool: the 14-day withdrawal period for consumer purchases doesn't apply.

10. Declined payment

If a charge fails, we retry and let you know. You have 7 days to change your card (Settings › Subscription › Card and invoices). After that, the workspace goes back to Free; your data stays intact and you can resume your plan at any time.

11. Availability and liability

We do our best to keep Fondacle available and reliable, without being able to guarantee it at every moment. Keep an export of your important data. Our liability is limited to direct damage caused by our fault.

12. End of use

You can stop at any time: export the files you want to keep, then delete your account (Settings › Delete my account). Everything is erased, permanently.

13. Changes

If these terms change, we'll let you know before they apply. They're governed by French law.

14. Our providers

These providers process data to run Fondacle, bound by contract to protect it and only use it for the service. Any change is announced to you 30 days in advance. If you need their names (for your own GDPR records), write to us: we'll give them to you.
